He was struck in the head. </P><DIV class="intext_area" id="intext_area_middle"><br />

<p>Trees might seem especially rare and precious in New York, but unlike many suburbs, the city generally imposes no restrictions on its residents&rsquo; removal of them. </p>
<p>&ldquo;Private property owners can treat trees as their own property &mdash; they don&rsquo;t need a permit to remove them,&rdquo; said Liam Kavanagh, first deputy commissioner of the city&rsquo;s parks department.</p>
<p>Of the five million or so trees in New York City, the <a title="More articles about Forest Service, U.S." href="http://topics.nytimes.com/top/reference/timestopics/organizations/f/forest_service/index.html?inline=nyt-org">United States Forest Service</a> estimates that about half are on private property, Mr. Kavanagh said. &ldquo;That includes trees in cemeteries and college campuses,&rdquo; he added. </p>
<p>There are several sections of the city, however, where private trees are more strictly regulated, most notably in wetlands, woodlands and other environmentally fragile places on Staten Island, in Queens and in the Bronx. In these districts &mdash; including Lighthouse Hill on Staten Island, the Fieldston area of the Bronx and the Fort Totten area of Queens &mdash; the city has broad discretion to limit or modify development to protect natural features. Homeowners in these areas must obtain city authorization before removing a healthy tree six inches or more in diameter, and if a tree is unhealthy, homeowners must present a letter from a certified arborist confirming that fact.</p>
<p>In general, Mr. Kavanagh said, &ldquo;we are extremely vigilant about trees in the public realm, especially parks and street trees, and we are aware that tree regulations in some other municipalities afford protection to private-property trees. I can only surmise that it&rsquo;s never been part of city policy to regulate what private property owners do with them.&rdquo; </p>

				<P>ALBANY &#8212; Workers who report being underpaid or otherwise mistreated on the job are getting stronger protection against employer retaliation under a state law that takes effect this week. </P><P>  The law increases the minimum penalty against employers from $200 to $2,000 and the maximum from $1,000 to $10,000. </P><P>  Whistleblowers are already protected from firing, demotion, reassignment and pay cuts. </P><P>  The state Department of Labor last year collected and paid $24.6 million to 17,000 workers affected by labor-law violations. </P></DIV><br />
